IF I BREAK UP WITH MY FIANCE WHO GETS THE ENGAGEMENT RING

He does. I don`t thing you should be thinking about that at this point but legally (an ethically ) speaking, he gets the ring back -- especially if he purchased it with no help from you.

The basis is : When you become engaged, it is essentially a legal contract saying you will promise to marry each other. The party who breaks the contract (as any contract) is at fault. If you break up with him, you break the contract and you have to give the ring up.

As noted by a very recent settlement where the ring was 40,000 (wow!) the court does RARELY allow the bride to be to keep the ring but the circumstances need to be out of the ordinary -- in the case, he was already married so he had no intention of marring her, therefore he broke the contract, she keeps the ring.

Best of luck to you, I would hope you could resolve your issues especially since you made the commitment to stay together for the rest of your lives but I suppose if you are now finding he is not right for you, now is the best time.

Ps you also return all gifts you have been given unless specifically stated by the giver not to give it back.
